My cousin was caught by security?
Well, for it to be shoplifting or, petit larceny as it is called in many jurisdictions, it should have been handled a little differently. They did not call the Police because they made the apprehension too soon. Before they can stop and apprehend for shoplifting, several criteria must be met. First, they must witness you select the item. Then, they must witness you conceal the item. Then, as a matter of "chain of custody" type issues, they must maintain constant observation of you while inside the store and on your way out. Finally, to constitute theft, you must p all points of sale. Now, that is the letter of things. However, in reality, based on the fact that he had the drink, partially consumed it and then left the container in another section fo the store, it is not unreasonable to ume he had no intention of paying for it. So, going to that whole "we reserve the right to refuse service" thing, they elected to make contact and formally advise him and have him acknowledge that he was no longer welcome on their property, which they can do. That the Security Director is willing to lift that "tresp", is a break for him. I am sure he will exercise better judgment in the future....correct?
